Will child support & Government assistance effect my tax return?

My ex and I have a beautiful daughter together.

For the past 8 months, I have been laid-off from my job and in result, have been able to receive WIC/Food Benefits & Medicaid.

In lieu of child support payments, my daughter and I live in my Ex’s home and he pays the mortgage and utilities. He took a job out of state, and was unable to sell his home- I needed a home, and this works out great for the both of us.

HOWEVER, I just got a letter in the mail stating I MUST begin receiving support checks through Friend of the Court. (They were made aware of my arrangements when I applied for benefits). The letter from FOC also stated that the state would reimburse themselves for my benefits out of these payments.

My Ex is now very concerned that if he claims our daughter’s SS# is on his tax return (He has, afterall, paid for all our living arrangements the past 6 months) that his refund will be withheld and sent to FOC- Basically, making him pay child support twice.

FOC has my daughter’s info & SS#, but I never gave my Ex’s name or info because I don’t want them to force him to pay again. - so it’s likely they will cancel my benefits.

Does anyone know if my Ex can still claim my daughter or will this adversely affect his tax refund?

    It sounds like you and your EX are on relatively good terms. I would recommend that you make everything official by having him pay you child support. Then you can write up a lease agreement where you lease the house from him. I recommend you actually transfer the payments each month via checks or money orders that can be documented. This way for future reference he can show proof that he actually paid the child support.

    You need a tax representative, sounds like they will hit him twice for last year, and the fight will start to get him some money back. Although this was done mutually benefitting, you need to go down and talk to someone right away. A lawyer might be a good option too, it sounds like they may not be able to help you without one, someone who can set up paperwork properly for them to see.
    If you witheld info on recieving the equivilant to cash, and noone knew about this, you are the one who will be put up for fraud, you do realize this right? So make sure its all above the board. He needs a lawyer as well, you two can use the same one, but this is a scary situation, the govt is right until you prove them wrong. Dont wait on this, I hope it all works out for you.
